Market abuse and spread-betting activity in an employer’s shares pending a profits warning

Background to Ruling

In James Parker v FSA the Financial Services and Markets Tribunal has dismissed a reference to it of an FSA finding of market abuse by a senior accountant, employed by a listed company, in respect of spread-betting activity in that company’s shares conducted by him prior to the company’s issuing of a profits warning.
