Trial Judge gives judgment on costs award following abandonment of BCCI liquidators claim against Bank of England
Joanna Gray, University of Newcastle
On 12 April Mr Justice Tomlinson delivered a judgment from the High Court in
Three Rivers District Council & Ors and BCCI SA (In Liquidation) v Governor & Company of the Bank of England
that brought to an end all the many years of litigation in this claim against the Bank of England brought by the liquidators
of BCCI on behalf of its creditors. In a sense this judgment also brings as much “closure” as there can be in a claim that
has been abandoned as opposed to adjudicated upon, and it is a remarkable judgment in many ways as indeed, was the liquidators’
claim itself.
