Periodical payments and appropriate index

The four defendant health authorities appealed against the first instance decisions that indexed periodical payments in respect of future care to the ASHE 6115 index rather than RPI. The Court of Appeal considered the circumstances in which it would be appropriate to award some part of the damages due to the claimants on a periodical payments basis and also gave consideration to the appropriate index to be applied if different from RPI.
