Liability Risk and Insurance
Causation and foreseeability of injury
The claimant had been employed as a dentist by a primary care trust. It appeared that in the last few years of her employment
she had experienced difficulty with the manager of the department where she worked, who had apparently made serious allegations
about her professional and personal conduct at work. The claimant was eventually dismissed following disciplinary procedures.
She claimed that she had suffered both psychiatric and physical injury due to the activities of her manager and her employers,
and the Court was asked to determine questions of causation and injury and foreseeability of the injury or damage.
