Limitation period should be disapplied
A fresh claim in an action for damages for personal injury issued after the first claim that had been brought outside the
time limit and had been struck out, gave the court a discretion under section 33 of the Limitation Act 1980 to decide whether
or not the limitation period should be disapplied.
