Discontinuance of group litigation

In group litigation on behalf of persons under a disability, where some claimants proposed to discontinue, they would not require the permission of the court if their discontinuance did not amount to settlement and their claim forms did not name any other claimant. The case involved the claimant and several hundred other claimants in a group legal action against Smithkline Beecham and others for damages arising from MMR/VR vaccinations.
