Evidence and submissions should be considered

When assessing loss of pension right, an employment tribunal had to consider whether a fair and equitable assessment could be worked out on the basis of the evidence and submissions put forward by the parties; it was an error of law to reject such evidence and submissions entirely on the basis that the parties’ approach was not one suggested in a guidance booklet.
