Award with interest does not beat payment-in

The Court of Appeal held that if an award of damages exceeded a payment into court only by virtue of accrued interest, it would not be regarded as beating an offer to settle under Part 36 of the Civil Procedure Rules. The court allowed the appeal from a decision on costs in a personal injury action against the claimant’s employer. An award of a total gross sum of £40,854 with interest was made.
