Employer can rely on defence of illegality

The Court of Appeal held that an employer was entitled to rely upon the defence of illegality where an employee complained of race discrimination but his complaints were so inextricably bound up with the illegality of his conduct in obtaining and continuing that employment that, if he were to be allowed to recover compensation for discrimination, the tribunal would appear to condone his illegal conduct.
