Allegation of prejudice against chairman

The Court of Appeal ruled that when the Employment Appeal Tribunal heard an allegation of prejudice against an employment appeal chairman who refused to stand down, it should not simply test the tribunal’s decision on the established test of bias. It should also consider the proceedings before the tribunal as a whole and decide whether a perception of bias had arisen.
