Suitability of work equipment

A bus driver was assaulted by a passenger. He brought a claim on the basis that a protective screen should have been in place to separate the driver from the passengers. The trial judge found in favour of the claimant and held that both negligence and breach of statutory duty had been proved. The defendant appealed the decision.
