Withdrawal of admission of liability

A school assistant injured her back whilst handling a child following a swimming lesson. Two years after the accident the council received a letter before action. The council’s insurers’ claims inspector decided that the most plausible explanation for her injury was that she was required to lean over into the swimming pool and lift the child out. He concluded that the school would be found liable and liability ought therefore to be admitted.
