No jurisdiction for overseas claim

A claim for unfair dismissal by a British employee of an English company who worked in the Ascension Islands could not be heard by an employment tribunal. An employment tribunal ruled that it had no jurisdiction to hear the unfair dismissal case. The Employment Appeal Tribunal had allowed the employee’s appeal, but the Court of Appeal allowed the employer’s appeal. Ascension Island is a dependency of St Helena, an overseas territory of the UK where legislative power was vested in the governor.
