Privatisation of access to justice

The Commercial Court declined to award costs against the commercial third-party funder of the experts of an unsuccessful claimant. This was despite the fact that if the claimant, who was represented on a conditional fee agreement, had been successful, the funder would have received a percentage of the sum recovered.
