The Court of Appeal allowed the claimant’s appeal in his personal injury claim which had been struck out by a lower court.
The claimant had suffered an injury in 1998, but had not served a claim form until April 2001, and then without any accompanying
particulars of claim, medical reports or schedule of loss.
