Subconscious bias in EAT panel

There was a real possibility of lay members showing subconscious bias where counsel appeared before a panel of the Employment Appeal Tribunal including one or two lay members with whom he had previously sat as a part-time judge. As a result, the House of Lords said that the practice which allowed such appearance should be stopped.
