‘Without prejudice’ rule and human rights

In the light of the Human Rights Act, the application of the ‘without prejudice’ rule whereby oral or written negotiations, seeking settlement of the dispute, were excluded as evidence, should be applied with restraint and only where the public interests underlying the rule were clear.
