As the Courts Bill proceeds, its potential impact on insurers comes up for consideration. Consultation and a Regulatory Impact Assessment, which included data from the NHS Litigation Authority and the ABI, led to the view that structured settlements offer significant advantages over lump sum awards, particularly in improving NHS cash-flow. It was believed that ‘it is possible that general insurers would make relatively small gains from such a proposal but it seems unlikely that such a proposal would significantly raise their costs.’
