Australian appeal succeeds in overturning award of A$700,000 to Rolah McCabe, the case to go to a fresh hearing. In the original hearing BAT were not allowed to mount any defence on order of the judge, as they were found to have shredded thousands of documents relating to the health effects of smoking and ‘likely to be of importance’ in litigation, thus damaging the claimants opportunity to put forward her case.
