Court can order compulsory treatment
Where a court can be convinced that medical treatment is a necessity and in the best interests of the patient, within article
3 of the European Convention on Human Rights, it has the power to over-ride the patient’s refusal of treatment. This in refusal
of judicial review of a certificate issued by a consultant forensic psychiatrist ordering regular anti-psychotic treatment,
against the wishes of the patient.
