No insurer challenge permitted

The Supreme Court of India has ruled that general insurance companies cannot challenge the level of compensation awarded by Motor Accident Claims Tribunals where the insured has not appealed. This decision, in National Insurance v Nicolletta Rohtagi will apply except where proved that insured and claimant were in collusion.
