TUPE does not create claim of constructive dismissal

Joined appeals against the Rossiter decision of 2001 found that the Transfer of Undertakings (Protection of Employment) Regulations (TUPE) were not intended to create a new right to claim for constructive dismissal. The EAT went too far in its reading of section 95(1)(c) of the Employment Rights Act.
