Psychiatric injury claim based on employer’s breach of trust and confidence

Held that a common law claim for damages for psychiatric injury, based on alleged breach of implied term of trust and confidence by an employer, was precluded by the House of Lords decision in Johnson v Unisys Ltd (2001). This even where the matters relied on pre-date dismissal; as in Johnson, the manner of dismissal must be the subject of employment tribunal proceedings.
