Criteria for disclosure
Where a party applied for disclosure of documents by a non-party to proceedings, to decide whether or not they supported its
case, the court should consider whether the documents “might well” fulfil that requirement. The threshold condition in rule
31.17(3)(a) of the Civil Procedure Rules should be applied.
