DuPont not racketeering

In appealing a damages hike to US$88.5mn on grounds of racketeering (under the RICO Act) in a Benlate claim by two Costa Rican nurseries, DuPont will be heartened by a ruling by judge Alan Gold of the Federal District Court in Miami. In another similar case, Judge Gold dismissed RICO claims from 34 growers who had entered into settlement for Benlate damage. He ruled their claim failed to meet the legal criteria required.
