Paraglider as aircraft? Student as passenger?

It was held that a paraglider was not an aircraft, nor was a trainee flying tandem with her instructor a passenger, her claim therefore not falling within the scope of schedule 1 of the Carriage by Air Acts and thus not statute barred. The defendant, as instructor, owed a duty of care to his trainee.
