Claims of sexual orientation

Following the same line as the Scottish Court of Session, in the recent MacDonald claim the Court of Appeal has confirmed that discrimination against a lesbian teacher, based on sexual orientation, is not covered by the Sex Discrimination Act. In the case at issue the correct comparator would have been the treatment of a male homosexual.
