It can be difficult to establish liability in claims involving injuries caused when trees fall onto the highway. The High
Court has held that a local authority and tree inspectors had been negligent through their failure to identify alleged structural
problems from the roots of a tree. The court found that Hampshire County Council had not been in breach of its duty, nor had
it been negligent when a tree fell onto a road, killing a father of three.
