ALAME AND OTHERS v ROYAL DUTCH SHELL PLC AND ANOTHER

Environmental damage – Group litigation order – Information required before order can be made

The claim brought by the various claimants arose out of oil spills in the Niger Delta. The claimants alleged that the defendant had failed to prevent, mitigate or remediate the oil contamination and was liable to compensate the claimants for the harm caused to them and to their communities. The defendant denied responsibility and submitted that the responsibility lay with third parties and that it was not liable as a matter of Nigerian law.
