‘Right of silence’ in civil cases

Subject to specific statute preventing statements made by directors in disqualification proceedings being used in subsequent criminal action, nothing in general law or the fair trial requirements of the European Convention on Human Rights stood in the way of a prosecution authority obtaining helpful ideas from other proceedings concerning the same subject matter. Such use would not infringe the traditional ‘right of silence’.
