Constructive dismissal

Resignation without notice after downgrading, following disciplinary proceedings, does not constitute dismissal within the meaning of the Disability Discrimination Act.The phrase ‘by dismissing him’ in section 4(2)(d) does not include constructive dismissal which involves an element of choice on the part of the employee.
