Injury definition under Warsaw Convention
A 15-year-old unaccompanied girl who suffered clinical depression after an indecent assault by a fellow passenger on a KLM
flight lost damages awarded in a lower court. It was held, on appeal, that an airline’s liability for ‘bodily injury’ under
article 17 of the Warsaw Convention did not extend to mental injury.
