Injuries to child passenger

Responsibility for injuries to a child passenger (not properly secured) following a road traffic accident, and defendant’s admission of negligence, are to be determined by application of the test laid down in section 2(1) of the Civil Liability (Contribution) Act 1978. In seeking what was just and equitable the decision of the court of appeal in Froom v Butcher (1976) would provide valuable guidance.
