UPC inches closer

In view of the court’s progress, Vittorio Cerulli Irelli and Lorenzo Battarino discuss how to tackle the remaining uncertainties

The Federal Government of Germany announced 1 in September that it ratified the Protocol on the Provisional Application of the Agreement (PPA) on a Unified Patent Court (UPC). Slovenia also passed legislation ratifying the PPA and on 15 October 2021, deposited its instrument of ratification. According to a press release 2 by the UPC Preparatory Committee, the PPA will enter into force after the imminent ratification by one additional member state. This should be Austria, also in the process of completing the PPA ratification process.
