Optis Cellular Technology, LLC, et al v Apple Retail UK Ltd, et al

England & Wales High Court - 27 September 2021

On 27 September, theHigh Court of Justice handed down its latest judgment in the ongoingmultipatent UK SEP dispute between Optis and technology behemoth Apple. Mr Justice Meade found that unless Apple commitsto enter into a court-set licence, the terms of which will be settled at thefair, reasonable and non-discriminatory (FRAND) trial scheduled for summer 2022(Trial E), it should be subject to a UK FRAND injunction restraining it frominfringing an Optis’ standard essential patent (SEP), which was previouslyfound valid and essential/infringed.
