Employer’s liability for commuting accident

A decision of the California Second District Court of Appeal in Los Angeles held that an employer may be liable for a road accident directly caused by an employee driving home after complaining that pesticide in use at work had made her ill. This, despite the normal exemption of employers under the coming-and-going-rule, in Barbara Bussard v Minimed Inc .
