Road accident stress claim fails
At a cost to legal aid of £250,000, and having rejected a settlement offer of £30,000, Elizabeth Fagan has lost her High Court
claim against a motorist who killed a police motorcyclist for her trauma in witnessing the event. Rejection of her claim was
based, at least in part, on her borderline personality disorder prior to the accident and secret videos casting doubts on
her claims of inability to work. Leave to appeal was refused, with concern expressed at the costs incurred.
