Two farmers purchased a herd of goats, but these later became infected. The seller pursued a claim for the unpaid balance of the purchase price, and the farmers counterclaimed for breach of contract. However, the counterclaim was struck out because the farmers’ solicitors failed to serve expert and other evidence in time. The sellers’ claim was settled for £5,000.
