No victimisation in employer’s approach to staff in dispute

An employer who acted honestly and reasonably to protect its interests in equal pay litigation brought against it by its employees, by trying to persuade them to settle those proceedings, did not discriminate against them by way of victimisation. The Court of Appeal so held in a reserved judgment allowing the appeal of a council against the dismissal by the Employment Appeal Tribunal of an appeal by the council against a decision by an employment tribunal upholding the complaints of employees of victimisation under section 4(1) of the Sex Discrimination Act 1975.
