Contract – The meaning of “construction contract” – Whether primary activity under the contract between the parties was power generation

The claimant brought an action in which it sought summary judgment in order to enforce the decision of an adjudicator. The defendant sought to resist the application on the ground that the adjudicator lacked jurisdiction because the contract which had been entered into between the parties was not a "construction contract" within the meaning of that term as used in the Housing Grants, Construction and Regeneration Act 1996.
