Brownsville Holdings v Adamjee Insurance

Brownsville Holdings v Adamjee Insurance (2000 2 Lloyd’s Rep. 458) is one of those rare examples of an allegation of willful casting away with connivance of the owner being proved. The judgment of Mr Justice Aikens, running to some 50 pages with over 300 footnotes, illustrates the careful attention to detail needed before such a finding of criminal conduct will be made. However, the case also reinforces the need for the assured himself to condescend to detail if he wishes to make good an assertion of loss by an insured peril.
