A resurgence of life interests in 1975 Act claims?
Claims under the Inheritance (Provision for Family and Dependants) Act 1975 (the 1975 Act) tend to create – or at least exacerbate
– animosity between the parties. Chances are that if such a claim proceeds all the way to trial, there will be no love lost
between the parties by the end of the trial. It might therefore be thought that the court should try to do its utmost to achieve
a clean break between the parties and let them both go their separate ways at the end of the dispute.
