Passengers

European Union law requires all passengers to be covered by compulsory liability insurance in respect of death or personal injury. The question referred to the European Court of Justice in Farrell and Whitty v Motor Insurers Bureau of Ireland (Case C-356/05), April 2007 was whether the compulsory insurance requirement extended to a person being carried in a vehicle not equipped for carrying passengers. In holding that this was the case, the Court has confirmed that the only passengers not entitled to protection under EU law are those who are, to their knowledge, being carried in a stolen vehicle.
