Lease renewal – superior landlord exercising break option – request by sub-tenant for a new tenancy – s25 notice served on sub-tenant which prevailed?

Fast Drinks Ltd v Cetyl International Group Inc [2016] EWHC 3501 (QB) (Morris J) (21 October 2016)

This case raised a novel point which had not previously been decided or considered, even though the Landlord and Tenant Act 1954 was enacted just over 60 years ago. It concerned a request by a subtenant for a new tenancy where the superior lease had been determined prior to the contractual expiry date of the subtenancy.
