The accrual of a claim

The key issue in Mulchrone v Swiss Life (UK) plc [2005] EWHC 1808 (Comm) was the date at which a claim against insurers under a personal injury policy accrued. As is often the case, the policy provided that payments would be deferred for a period after the assured’s disability. Gavin Kealey QC, sitting as a deputy High Court judge, concluded that the relevant date was the date of the accident and not the date on which the deferral period came to an end and payments fell due.
