Notification obligations

The Court of Appeal in Tioxide Europe Ltd v CGU International plc [2005] EWCA Civ 928 has upheld the first instance decision of Langley J ( [2005] Lloyd’s Rep IR 114) but the appeal was confined to a threshold issue concerning the validity of the notification of a claim. The first instance decision raised a range of further issues which in the event did not need to be considered on appeal.
