Utmost good faith

The decision of David Steel J in Markel International Insurance Co Ltd and another v La Republica Compania Argentina de Seguros and another [2005] Lloyd’s Rep IR 90 was on the preliminary question of whether the English court should assert jurisdiction over an utmost good faith dispute. Much of the reasoning is routine, but important issues of principle on materiality in reinsurance did call for some consideration.
