Coverage and claims

The decision of Langley J in Tioxide Europe Ltd v CGU International Insurance plc [2004] EWHC 216 (Comm) raises a large number of issues affecting the coverage of a product liability policy and the manner in which claims are to be made where the insurance is arranged in layers. The learned judge’s analysis of coverage for small losses where there is no aggregation provision is of particular interest.
