The issue before Morison J in Goshawk Syndicate Management Ltd and others v XL Speciality Insurance Co [2004] EWHC 1086 (Comm) was a short but difficult one, on the construction of policy deductibles. The judge has given permission to appeal to the Court of Appeal. At first instance the case turned largely on the doctrine of back-to-back cover.
