In King and others v Brandywine Reinsurance Co (UK) Ltd [2004] EWHC 1033 (Comm), forthcoming in [2004] Lloyd’s Rep IR, Colman J has resolved a number of issues between reinsurers and their retrocessionaires arising from the catastrophic grounding of the Exxon Valdez some 15 years ago. Many of the issues concerned the scope of the underlying cover, and were largely questions of interpretation of very specific wording, although there were also some issues that related purely to the retrocession itself.
